INTERNATIONAL LEGAL BASIS ENERGY CHARTER

Abstract

The article considers the international legal basis of the Energy Charter. Analyzes of the Final Document of the Hague Conference of the Energy Charter and the Energy Charter Treaty. It is proposed doctrinal classification of documents of the Energy Charter, given their general characteristics and legal assessment. The classification of the subjects of the Energy Charter process, depending on their legal status and the degree of participation in the Energy Charter. Advertised problems of the Energy Charter, as a complex legal phenomenon and examines the place of the Energy Charter in the system of international legal relations, implemented in the energy sector. Special attention is paid to the identification of an international organization in the Energy Charter process. Determined by the degree of participation in the Energy Charter process of Belarus.
