ADMINISTRATIVE PREVENTIVE MEASURES AS A MEANS OF FIGHTING UNFAIR COMPETITION

Abstract
The article analyzes administrative preventive measures as a variety in the system of measures of administrative coercion in relation to the sphere of combating unfair competition. Based on the analysis of the activities of the antimonopoly authority in the Republic of Belarus, the author comes to the conclusion that issuing warnings about the inadmissibility of violating the antimonopoly law (including unfair competition) is an administrative preventive measure. However, insufficient legal regulation aimed at ensuring the implementation of warnings does not allow to effectively implement this mechanism in practice, in connection with which the article substantiates proposals for improving the legislation governing the relations in question.
