THE BEST INTEREST OF THE CHILD AS A RULE OF PROCEDURE

Abstract
The article is devoted to the study of one of the elements of the concept of ensuring the best interest of the child. The best interest is considered as the rule of procedure. Based on the list proposed by the Committee on the Rights of the Child in General Comments No. 14, the author reveals the content of the procedural guarantees necessary to ensure the best interest of the child, based on national and foreign legislation, international human rights standards and legal doctrine. The conclusion is made about the necessary changes in national legislation in order to comply with international standards for the protection of the rights of the child, in particular, amendments to the regulatory legal acts of the Republic of Belarus, fixing the specific age of the child as the basis for taking into account his opinion when deciding issues related to the implementation of children's rights.
