PROTECTION OF THE DEFENDANT AGAINST A CLAIM FOR DAMAGES

Abstract
The author considers the defendant's remedies against a claim for damages in terms of their effectiveness. The author analyzes the problem of defense of the defendant against the claim on the basis of scientific research of Soviet, Belarusian, and Russian scientists. Based on the research of approaches to the definition of remedies identified in the scientific doctrine, the author identifies three main remedies for the defendant: objections to the claim, denial of the claim, and counterclaim. As a result of the analysis of the norms of the Civil procedure code of the Republic of Belarus, the author identifies only two of them: an objection to the claim and a counterclaim. These remedies against the claim are considered by the author taking into account the judicial procedure in cases of damages. The author comes to the conclusion that among the remedies provided for by law in court cases for damages, the most effective is an objection to the claim.
