LEGISLATIVE SEPARATION OF SURVEILLANCE AND SIMULTANEOUSLY CONDUCTED OPERATIONAL SEARCH ACTIONS

Abstract

Some contradictions of the Law of the Republic of Belarus are considered "On operational search activities" in terms of regulating the division of surveillance and such operational search activities carried out jointly with it as operational survey, operational inspection, verification purchase, controlled delivery, operational experiment, operational implementation. To eliminate these contradictions, it is necessary to take into account a number of factors: the coincidence of persons directly involved in the monitoring and one of these activities, as well as the Commission of actions that restrict constitutional rights. On the basis of modeling of situations of carrying out operational search actions, the formulation that most accurately reflects the circumstances in which there is no restriction of constitutional rights is developed. Offers made to change the second part of article 37 of the Law of the Republic of Belarus "On operational search activities".
