Abstract

housing legal relationsHousing legal relations with the participation of minors, as well as relevant legal regulation, have specific features related to their special status, which indicates the need for clear legal regulation in this area. Effective protection of the right of a minor to housing is possible only if he takes into account his family and legal status. Legal status includes as elements not only a set of rights and duties provided for in the law, but also guarantees. In the process of reforming legislation, the interests of minors must be taken into account. However, as the analysis of sectoral legislation and judicial practice, it is not excluded the assignment of the minor child to former family members and check out him together with her mother after her divorce from her husband-the owner of the dwelling. The benchmark for the courts should be the maximum protection of minors, including eviction.
