THE TYPES OF SUBJECTS OF LEGAL RELATIONS ARISING IN CONNECTION WITH THE REGISTRATION AND USE OF THE DOMAIN NAME IN THE REPUBLIC OF BELARUS

Abstract

The author identifies two conditional groups of subjects of legal relations related to the use of domain names: subjects of mandatory (contractual) relations and subjects of property relations between the owner of the domain name and other persons. The first group of subjects includes the applicant, Registrar, domain administrator, administrator of the national domain zone, technical administrator of the national domain zone. The subjects of compulsory (contractual) relations can also include the state as a regulator of the system, as well as international organizations that provide regulation of the functioning of the Internet. The second category of subjects-the subjects of property relations between the owner of the domain name and other persons. The author making a conclusion about that international organizations, the Republic of Belarus, the Operational and analytical center under the President of the Republic of Belarus as the national administrator of top-level domain names, the technical administrator of top-level domain names do not have a property right in relation to top-level domain names.
