ON SOME MEANS OF INFLUENCE ON THE VICTIM IN CASES OF HUMAN TRAFFICKING

Abstract

On the analysis of law enforcement practice, the conclusion is made that the dependent position as a situation, the occurrence of which is directed at the actions of the perpetrator, can be used as an attribute that enables evaluation of some means of influence on the victim as modus operandi of human trafficking. The author concludes that the abuse of a position of vulnerability of the victim is not a sort of other ways of committing human trafficking (deception, fraud), and therefore it is expedient to include it as a modus operandi of human trafficking in the disposition of Art. 181 of the Criminal Code. The coverage of possible means of influence on the victim from the point of view of their orientation towards placing him in a dependent position makes it possible to identify certain characteristics and circumstances of the crime, the presence of which allows to conclude that the guilty person has applied such means of influence as deception, fraud, abuse of his position of vulnerability. These characteristics can be classified depending on what form of dependence they lead.
