THE OBJECTS AND PURPOSE OF PRESENTATION FOR IDENTIFICATION: DISCUSSION ISSUES IN THE CRIMINAL PROCESS AND CRIMINALISTICS

Abstract

The article presents an author’s view on the issues of objects and the purpose of presentation for identification, which are ambiguously solved in the theory of criminal process and criminalistics. According to the results of the analysis the following conclusions are drawn: 1) only individuals, objects, corpses and animals can be presented for identification; the presentation for identification of buildings, areas of the terrain, voice and speech, handwriting, smell, about the possibility of which the criminalists indicate, contradicts the norms of the criminal procedure law; since the law enforcer has to deal with situations where recognition of the listed objects is necessary to solve the tasks of the investigation, questions should be worked out on how to work with them; 2) only persons can be presented for identification by photo; 3) the purpose of identification is the establishment of identity or difference with a person or an object previously observed by the identifier; if the achievement of this purpose is impossible for any reason, identification should not be conducted.
