THE DOCTRINE OF FRANTSISKA SKORYNY ABOUT LAWMAKING AND ITS VALUE FOR THE PRESENT

Abstract

Article is devoted poorly investigated problem – to the doctrine of Frantsiska Skoriny about lawmaking. Are considered the doctrine of Skoriny about the law, on principles to which there should correspond the law, on the natural right, on leadership of the natural (divine) right. In article the major legal ideas of Frantsiska Skoriny about law and right coincidence, about a parity between moral (divine) and legal laws, on unity of the right for all estates of Grand duchy Lithuanian are analyzed. In article the doctrine of Frantsiska Skoriny about right branches, practical application of this doctrine in structural construction of the Statute of Grand duchy of the Lithuanian 1529 is investigated. The principles of lawmaking developed Frantsisky Skorinoj have methodological character, they answer universal values, in many respects advanced the time. Frantsisk Skorina has brought the considerable contribution to the European treasury of legal doctrines. In the light of the doctrine of Frantsiska Skoriny in article some modern problems lawmaking – value justices, marriage contracts, legitimacy of unisex marriages, sights of orthodox church at these problems are analyzed.
