ON THE DEVELOPMENT OF CRIMINAL PROCEDURE IN THE REPUBLIC OF BELARUS

Abstract
The rules of appeal procedure in criminal cases introduced in the Law of the Republic of Belarus No. 356-3 dated January 5, 2016 are studied. The Belarusian appeal system is compared with the Russian and Ukrainian law. The establishment of the Courts of Appeal is viewed as a new stage in the development of the criminal procedure in Belarus. The Author suggests that the dissolution of the Courts of Cassation, absence of the right to appeal to a verdict or a decree of the Supreme Court of the Republic of Belarus do not correspond with the Constitution. The following amendments are suggested: change the process of examining evidence in the Courts of Appeal and questioning witnesses, victims and experts; change terms of case provision to the Court of Appeal.
