DIGITAL TRANSFORMATION OF LEGAL RELATIONS SUBJECTS: ELECTRONIC LEGAL ENTITY, ELECTRONIC STATE BODY, DIGITAL OFFICIAL

Abstract

The article shows the problem of transformation of subjects of legal relations in the context of digitalization from the constitutional position. Such subjects as an electronic legal entity (commercial legal entities, political parties, public associations), an electronic government agency, and a digital official are considered as potential areas of such transformation. The article mainly reveals the legal aspects of the transition of "typical" subjects of law from a physical to a digital shell. It is proposed to introduce the category of "electronic legal entity" into the legal area, providing for the possibility of a legal entity to fully carry out internal and external activities in the digital environment (for example, such an element as the location of a legal entity in the form of a physical address should become optional). At the same time, attention is drawn to the fact that the transformation of the subject composition of legal relations requires the development of additional legal guarantees to ensure constitutional order. The introduction of new elements into the subject composition of legal relations should not entail a decrease in the level of legal protection of other subjects of law.
