LEGAL MECHANISMS FOR PROTECTION AGAINST MOBBING: DOMESTIC LEGAL REALITIES AND EXPERIENCE OF FOREIGN COUNTRIES

Abstract
The article discusses the problem of mobbing in the Republic of Belarus and some foreign countries. The concept of “mobbing” is analyzed, its main features and types are highlighted. The author notes that the problem itself in our country is not designated as dangerous and has a low quantitative indicator, there is no current statistical information on mobbing, there is very little data on this phenomenon and it is inconsistent. The main problem in the field of countering mobbing is its hushing up for fear of losing a job and the lack of a legitimate response algorithm in such situations. There are no legal mechanisms to protect workers from mobbing in our country, and in most cases, actions of this kind remain unpunished. Certain articles of the Labor, Civil, Administrative and Criminal Codes regulate relations only in the case of certain (by no means all) actions; in this regard, the experience of some foreign countries deserves attention.
In conclusion the author offers some measures to prevent and fight mobbing.
