PROBLEM ASPECTS OF THE EXECUTION AND SERVING OF PUNISHMENT IN THE FORM OF ARREST AND IMPRISONMENT IN RELATION TO MINORS IN THE REPUBLIC OF BELARUS

Abstract

This article comprehensively analyzes the problematic aspects of the execution and serving of arrest and imprisonment sentences for minors in the Republic of Belarus. It is established that the current penal legislation does not contain special conditions for minors serving arrest, which reduces their special legal status and hinders their ability to receive continuing education. The author proposes specific legislative changes to the execution and serving of arrest sentences: enshrining the right to education, expanding the system of preferential conditions by introducing permission to receive additional transfers and spend funds, and introducing the expungement of criminal records after serving arrest as an incentive. For minors serving imprisonment sentences, the need for the active use of the institution of public educators and the creation of "new type" social rehabilitation centers with a phased reintegration into society is substantiated. The implementation of the proposed measures will humanize the penal system, reduce recidivism, and improve the effectiveness of the resocialization of minors.
