FOREIGN ELEMENT IN THE NATIONAL LEGAL SYSTEMS: HISTORIOGRAPHY PROBLEMS

Abstract
Studied historiographical framework for the analysis of interaction of legal systems and foreign elements. The main historical stages of the formation of the doctrine of recognition of a foreign element of national law. Particular attention is paid to the medieval period of formation of the doctrine of the interaction of legal systems and foreign elements. The analysis of the theoretical views of scientists in the field of comparative law and private international law. The necessity of theoretical understanding of problems in the functioning of the foreign element. The conclusions about the prospects for the development of the theory of operation of a foreign element in the national legal environment. Particular attention is paid to the concepts and categories of foreign and domestic law, as well as the need to develop theoretical concepts of “foreign element” and “national law”. Indicated on the particular importance of these categories for the practice of law-making and enforcement.
