THE FUNCTION AND PURPOSE OF THE COMPARATIVE LAW

Abstract

There are the problems of definition of the functions and purposes of science of comparative law. These concepts are discussed in relation to comparative law as an independent science. Function and purpose of the research directions are considered at the general level research facilities comparative law, in connection with which conducted the delineation of the functions of comparative law as a legal science methodological and private comparison function that occur during specific comparative legal studies. There are different approaches, developed in the field of comparative jurisprudence. An analysis is of the use of comparative law at two levels – national and international. Comparative legal functions discussed in relation to two main areas – national legislation and international relations. Accordingly, we have two basic functions – “intra” and “unification”. It’s noted that the main purpose of comparative jurists at the international level is the legal provision of integration processes. It’s indicated on integrative communication functions and purposes of comparative law.
