MANIPULATION OF A SUBJECT’S WILL IN THE CONTEXT OF CONSENT TO PROCESSING OF PERSONAL DATA: LEGAL ASPECT

Abstract
The article examines the specifics of the manipulation of the data subject’s will in the digital environment. The legal regulation of this issue is viewed from the perspective of the requirements for the consent of a personal data subject under personal data legislation, as well as foreign experience of legislative regulation. The existing legal framework is based on an expansive interpretation of the general principles of freely given, unambiguous and informed consent. The role of artificial intelligence in manipulation of users' expression of will is explored. The author offers an original definition of the manipulation of the expression of will of a personal data subject. Specific directions for legislation improvement in the context of the issue are proposed. In order to address the identified legal gaps, proposals for advancement of the Law of the Republic of Belarus «On protection of personal data» are justified, including the establishment of relevant definitions, the imposition of special responsibilities of operators and the introduction of a ban on manipulative design.
