LEGAL STATUS OF THE TITLE OWNER IN THE REPUBLIC OF BELARUS: LEGAL NATURE AND PRACTICAL ISSUES

Abstract
The article examines the legal status of the title owner in the Republic of Belarus through the lens of the divergence between formal registration of ownership and the actual scope of rights to possess, use, and dispose of property. Based on an analysis of judicial practice, notarial procedures, and public clarifications issued by state authorities, the author formulates a definition of the title owner as a person indicated in registration documents without any guarantee of correspondence with the actual composition of co-owners. The article identifies risks arising from the alienation of real estate and vehicles, particularly in the context of spouses’ joint ownership. The 2025 legislative amendments in the field of state registration of real estate are evaluated for their impact on addressing this issue. The study concludes that a regulatory gap remains in the automotive sector and proposes directions for improving the registration model to enhance legal certainty and balance the interests of participants in civil transactions.
