ENSURING INSTITUTIONAL AUTONOMY OF THE LEGAL SYSTEM OF THE REPUBLIC OF BELARUS: THEORETICAL AND LEGAL ASPECT

Abstract

This article examines current theoretical and legal issues related to ensuring the institutional autonomy of the legal system of the Republic of Belarus in the context of its interaction with other social institutions and the external legal environment. The institutional approach emphasizes the social determinacy of law and examines the national legal system not only in its internal dimension but also from the perspective of the legitimization of law as perceived by society and the willingness of members of society to comply with established norms. It is emphasized that the national legal system evolves from the characteristics of a given society, its previous historical path, social ties, culture, language, and worldview. Accordingly, the institutional autonomy of the legal system of the Republic of Belarus is predetermined by a system of specific features of lawmaking, including the autonomy of professional vocabulary, style, and argumentation, which are rooted in its own legal doctrine and law enforcement practices, and is objectively conditioned by the charac-teristics of all social institutions established in the country. Experience in ensuring the institutional autonomy of legal systems has been accumulated in international standards on lawmaking, parliamentarism, and the independence of judges, prosecutors, and lawyers. The author believes that implementing such standards into national legislation could be useful for strengthening the institutional autonomy of the legal system of the Republic of Belarus.
