CONSTITUTIONAL LEGAL PERSONALITY OF THE POPULATION OF AN ADMINISTRATIVE-TERRITORIAL UNIT IN THE REPUBLIC OF BELARUS

Abstract
The authors examine various aspects of the constitutional legal capacity of the population of an administrative-territorial unit as a subject of constitutional legal relations. The authors conclude that there are multiple forms of public participation in the exercise of constitutional rights and freedoms. Based on the analysis of legislation, the authors formulate a conclusion on the need to apply a differentiated approach to understanding the population of an administrative-territorial unit in the context of securing its rights and obligations. Proposals are formulated to improve the legislation of the Republic of Belarus on local self-government in the field of expanding forms of public access to managing the affairs of society and the state in the context of the introduction of information technologies. The authors conduct a comparative analysis of the concepts «population of ATU», «people», «local government bodies», the result of which was a proposal to introduce a legislative definition of the term «population of ATU» into the Law of the Republic of Belarus «On the administrative-territorial structure of the Republic of Belarus».
