CATEGORY “LEGAL FAMILY” IN THE STRUCTURE OF THEORETICAL AND METHODOLOGICAL BASIS OF THE COMPARATIVE JURISPRUDENCE

Abstract
The concept of legal family is considered from the perspective of inclusion of this category in the structure of the theoretical and methodological foundations of comparative law, the presence of which indicates the status of an independent comparative law. Legal family for the first time in legal science is defined as the total typical model of the comparative jurisprudence, which must comply with the general objects of comparative studies a lawyer works with. It is proposed to consider the following common characteristics of legal systems essential features of this category of model nature: common sources and systems of law, regulatory community, and the uniformity of the legal conceptual foundation. All national legal systems are included into these uniformities by copying of substantial properties, characteristic for all families. It results in establishing of family belonging of this or that legal system. It is proposed to consider a typical comparative model as the original model of comparison.
