Аннотация
Исследуются теоретические и практические особенности института цифрового наследования. Обосновывается актуальность и разработанность темы в юридической науке. Анализируется законодательство США на предмет наличия и характера, содержащихся в нем правовых норм, идентифицирующих категорию «цифровое наследование». Проведен сравнительный анализ положений законов и законопроектов в различных штатах, регламентирующих особенности правового статуса субъектов и объектов института цифрового наследования. Рассмотрен вопрос о включении норм, посвященных цифровому наследованию, в систему законодательства США. На основе доктринальных и законодательных представлений сформулировано определение цифрового наследования. Демонстрируется обзор ключевых положений, посвященных институту цифрового наследования в праве отдельных штатов, которые на законодательном уровне обсудили вопрос законодательной регламентации института цифрового наследования.
