EXPERIENCE CODIFICATION REGULATORY IN CIVIL LAW (THE EXAMPLE OF GERMANY)

Abstract
Examines the history of the codification of German civil law. Defines the basic conditions conducive to the development of a unified Germany civil law. Special attention is paid to the German legal doctrine and revealed its influence on the process of preparing the German Civil Code. Indicate the nature of social relations and especially the German state, which historically preceded the codification of civil law. Specifically deals with the history of the German land rights during their fragmentation. Addresses the problems associated with the development of the German Civil Code. The modern state of civil law in Germany, as well as reform of the law of obligations in 2002. Draws attention to the EU directives and analyzes their impact on the civil law of Germany. Conclusions regarding the current state of civil law in Germany.
