CODIFICATION REGULATORY EXPERIENCE IN CIVIL LAW (THE EXAMPLE OF FRANCE)

Abstract
On the example of France is considered the codification rulemaking in civil law. An analysis of the historical experience and the results of the rulemaking codifying the regularities inherent in the French legislator. Identifies problems codification process, as well as periods and form of codification. Determined the influence of civil law to other areas of law. Special attention is paid to new institutions of civil rights and their implementation in the structure of the civil codes. Draws attention to the experience in structuring law institutions, which have a complex legal nature or requiring identification. Discusses possible options transformation of traditional institutions of civil rights and the prospects for their improvement. On the basis of this study are announced proposals for a possible borrowing normative experience of France. Conclusions concerning the codification experience rulemaking.
