RETHINKING CONSTITUTIONAL VALUES INFLUENCED BY THE DIGITALIZATION PROCESS (Part 1)

Abstract
The concept, nature, essence, and key features of value rethinking are explored. The interdisciplinary etymology of the category is illustrated. Conceptual approaches and key aspects of its understanding are identified and examined in detail: social phenomenon, social process, desired goal, and specific state. The factors that shape, change, and lose values are elucidated and explained within the paradigm of the individual as a personality and society as a social organism. Individualization is highlighted as a criterion for the assimilation of values. Examples on a global scale illustrate the mechanics and process of understanding and rethinking values. Their correlation with change due to the virtualization of social communication is discovered. The category of "trending of values" is introduced, reflecting their actualization. The presumption of innocence is used to advance and argue the thesis that rethinking individual constitutional values is inadmissible. The role of subjects and the importance of targeted, managed, and controlled rethinking are highlighted. Forms for its implementation are proposed, including legal monitoring and public discussion. Problems of legal regulation and law enforcement practices in the Republic of Belarus are identified; proposals for improving the latter are made.
